How are Fees Charged in a Personal Injury Case?

Fees in personal injury cases are based upon a “contingent fee” schedule. That means that my fee is based upon a percentage of the fee recovered on your behalf, usually somewhere between 33 and 40 percent of the total recovery. The amount of the fee varies depending upon the complexity and individual facts of each case and is agreed upon by you and me, in writing, at the beginning of the case. Although I will frequently advance incidental out-of-pocket costs and expenses as necessary, filing costs, transcript, video and court-reporter fees for depositions and hearings, and other significant out-of-pocket expenses such as expert witness fees are the client’s responsibility.
